1. Description of Service

HamTesting.com provides free amateur radio license exam preparation tools, including practice tests, spaced repetition study sessions, and a browsable FCC question pool. The Site is intended for educational purposes only. We do not administer official FCC licensing exams and make no guarantee that use of the Site will result in passing any licensing exam.

2. Eligibility

The Site is available to anyone interested in amateur radio exam preparation. By creating an account, you represent that you are at least 13 years of age. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.

3. User Accounts

You may create an account using Google Sign-In. You are responsible for maintaining the security of your Google account and for all activity that occurs under your HamTesting.com account. You agree to:

• Provide accurate information when creating your account.
• Not share your account credentials or allow others to access your account.
• Notify us immediately if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to use the Site to:

• Violate any applicable local, state, national, or international law or regulation.
• Attempt to gain unauthorized access to any part of the Site or its infrastructure.
• Scrape, crawl, or systematically download Site content in bulk without our written permission.
• Interfere with or disrupt the integrity or performance of the Site.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Use automated tools, bots, or scripts to interact with the Site in a manner not intended for ordinary users.

5. Intellectual Property

The FCC question pool used on this Site is in the public domain and published by the American Radio Relay League (ARRL) and the National Conference of Volunteer Examiner Coordinators (NCVEC). All other content on the Site — including but not limited to the site design, layout, software, and branding — is owned by JWB Solutions and protected by applicable copyright and intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our proprietary content without our express written consent.

6. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the collection and use of your information as described in the Privacy Policy.

7. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or currency of any content on the Site, including practice questions. Always verify exam content against the official current FCC question pool published by the NCVEC.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, JWB SOLUTIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED FIFTY DOLLARS ($50).

9. Third-Party Services

The Site uses Google Sign-In for authentication. Your use of Google's services is subject to Google's own Terms of Service and Privacy Policy. We are not responsible for the practices or content of any third-party services linked to or from the Site.

10. Termination

We reserve the right to suspend or terminate your access to the Site at any time, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Effective Date" at the top of this page. Your continued use of the Site after any changes indicates your acceptance of the updated Terms. We encourage you to review these Terms periodically.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which JWB Solutions operates, without regard to its conflict of law provisions.
